Active duty members can get their prenup draft reviewed by a JAG lawyer at their base legal office for free. Your partner should also have it reviewed by an attorney. Do not sign anything until both parties have reviewed it with legal counsel.
Both parties must sign the prenup in front of a notary before the proxy marriage ceremony. If you are stateside, use Proof.com for remote online notarization. If you are overseas, your base JAG office provides notary services. If your partner is a foreign national overseas, they can use their nearest US Embassy or Consulate.

Military members who are not using a proxy marriage service can still use this tool. When you start, select that you are not planning a proxy marriage and you will be asked what state your wedding will take place in. That state becomes the governing law for your prenup.
A prenup addresses financial rights between spouses. It does not affect your eligibility for military benefits like TRICARE, BAH, or DEERS enrollment. Those benefits are based on your marital status and dependency status, not on the terms of your prenup. Your JAG lawyer can answer specific questions about your situation.
