This is not legal advice

ProxyMarriagePrenup.com is a document preparation service. The information provided on this site and the documents generated by this tool are for general informational and preparatory purposes only. Nothing on this site should be construed as legal advice. We are not a law firm and we do not provide legal representation of any kind.

This draft is not a binding legal document

The prenuptial agreement draft generated by this tool has no legal effect until it has been reviewed by a licensed attorney or JAG officer, signed by both parties, and properly notarized in accordance with applicable law. A document generated by this tool that is not reviewed, signed, and notarized is not a prenuptial agreement and provides no legal protection to either party.

Laws vary by state

Prenuptial agreement requirements vary significantly from state to state. This tool is designed for use in connection with a Montana proxy marriage and produces a draft governed by Montana law. If you are stationed in, reside in, or plan to divorce in another state, the laws of that state may affect the enforceability of some or all provisions of your prenup. A licensed attorney in your state of residence can advise you on this.

Military law is specialized

Military-specific provisions in this tool, including those related to USFSPA, SBP, TSP, SCRA, and security clearances, are based on general information about federal military law. These areas of law are complex and change over time. We strongly recommend that all active duty military members have their prenup draft reviewed by a JAG lawyer before signing. JAG review is free for active duty members.

No guarantee of enforceability

Proxy Marriage Prenup makes no warranty, express or implied, that any prenuptial agreement draft generated by this tool will be enforceable in any court or jurisdiction. Courts may decline to enforce prenuptial agreements for a variety of reasons including procedural defects, unconscionability, duress, or failure to meet state-specific requirements. Only a licensed attorney can advise you on the enforceability of your specific agreement.

Use at your own risk

Your use of this site and any documents generated by this tool is entirely at your own risk. Proxy Marriage Prenup, its owners, and operators expressly disclaim all liability for any legal outcome, financial loss, or other consequence arising from your use of this site or any document generated by this tool.

Get proper legal review

Before either party signs a prenuptial agreement generated by this tool, both parties should have the document reviewed by a licensed attorney. Active duty military members can obtain free legal review through their base JAG office. We cannot stress this strongly enough. This tool is a starting point, not a finished legal document.
